Blue Book Services, Inc. (“BBSI”) takes your privacy seriously. BBSI’s Privacy Policy is described herein. Please review this Privacy Policy thoroughly. In the event you do not accept the terms of this Privacy Policy you must discontinue use of BBSI’s Products and Services, including this Web Site, immediately. Your use of BBSI’s Products and Services, including this Web Site, is also governed by BBSI’s Terms of Use. Additionally, your use of BBSI’s Products and Services may be governed by the BBSI Member Agreement and any other agreement entered into between you and BBSI.

Data Security

To prevent unauthorized access, maintain data integrity, and ensure the correct use of information, BBSI has put in place physical, electronic, and managerial procedures to safeguard and secure the information we collect. For instance, credit card payment information is processed and protected by PayPal, Inc., our online payment services partner through use of a secure billing system. Both BBSI and PayPal use various security measures to protect against unauthorized access to your credit card information including firewalls, encryption, and secure servers. Neither BBSI nor PayPal use or voluntarily share credit card information for any purpose other than described herein.

Please be aware, however, that no Internet-based computer system can be considered 100% safe from intrusion. By accessing and using the Web Site, you understand and agree that BBSI shall not be liable for any losses you may incur in the event your information is obtained by “hacking” or other nefarious means.

Cookies and IP Addresses

For your protection, BBSI uses security cookies to authenticate the identities of web site users. We also use cookies to customize and improve our users’ experience on the Web Site. Cookies are small files placed on a computer’s hard drive by programs and web servers. If this functionality has been turned off on your computer, some of the functionality of our Web Site will not be available to you.

An Internet protocol (“IP”) address is a set of numbers that is automatically assigned to your computer when you access the Internet. Web servers identify your computer by the IP address assigned to it during your online session. BBSI may use the IP addresses of our users to help diagnose problems with our servers and to administer the web site.

BBSI may also use cookies and/or IP addresses to measure certain traffic patterns, such as which areas of the Web Site you have visited. We may use this information to refine, improve, and customize the experience and content you and other users will see on the Web Site.

Please note that the e-mail sent via our Web Site is not encrypted and does not provide for completely secure and private communications. It is possible that any e-mail messages sent via our Web Site may be accessed and viewed by others without your knowledge and permission.

The Information We Collect

This Privacy Policy applies to all information submitted to BBSI, whether entered by you via BBSI’s Products and Services or otherwise collected by BBSI. BBSI is the sole owner of the information collected and will use it only as described herein.

Business Information

If you register to become a Blue Book Member, we will endeavor to collect information from you about your business, such as trade name, addresses, contact information, personnel names and background. All such information becomes a part of the BBSI database which may be accessed by entities and individuals that utilize our services. Additionally, you may submit financial statements, accounts receivable information, and other information about other businesses and individuals, such as names, addresses, classifications, and your trading experience with these businesses or individuals. Similar information may be provided by others, members and non-members. BBSI may use this business information to create or improve Products and Services (e.g., Business Reports) for sale to the public or to license the use of such information to a third-party business partners. BBSI will not voluntarily disclose financial statements or the source of any accounts receivable or trade experience information you may provide without your permission except in those special instances described in the section titled Necessary Disclosures below. Similarly, BBSI will not disclose any notes you may enter via the “Notes” functionality of BBSI’s Products and Services without your permission, unless the disclosure is deemed necessary as explained below.

Order Information

Members and non-Members may order certain BBSI Products and Services online. When you place an order via our Web Site you will be required to provide personally identifiable information in connection with completing the Order Form. The requested information may include such data as your credit card information, your name, trade name, addresses, and telephone and fax numbers. Such information will be used by BBSI and our third-party online payment services partner, PayPal, Inc., to complete your order, deliver the requested product or service, manage your account, provide customer service, and comply with legal and regulatory requirements. Neither BBSI nor our third-party online payment services partner, PayPal, Inc., sells or voluntarily transfers this order information. (See sections on Necessary Disclosures and Data Security below.) BBSI may, however, use order information to update and verify the information contained in our Databases (e.g., addresses), including information used to create Products and Services, and to conduct market research and analysis.

Access Codes & Non-Transferability of User Content and Configurations

BBSI will not disclose, use, or voluntarily transfer access codes or credentials used to access the Web Site except as deemed necessary for testing and auditing purposes, and except in those special instances described below (see Section on Necessary Disclosures immediately below). Please be advised that access codes and any user content or configurations (e.g. user-entered notes or classifications, saved searches, or saved lists) will not be transferred to, or made accessible by, any other account, following a change in the employment status of an individual.

Necessary Disclosures

BBSI may access and disclose any information we have collected in special instances when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who might be violating their legal obligations to BBSI, or may be causing injury to or interference with (either intentionally or unintentionally) BBSI’s rights or property, or other users of BBSI’s Products or Services. BBSI may also access and/or disclose any information when we believe in good faith that such access and disclosure is required by law or necessary to avoid liability.

You may find links to other web sites on our Web Site. BBSI provides such links for your convenience, however, we cannot guarantee that these web sites adhere to similar privacy standards.

Disclaimer of Liability

Under no circumstances shall BBSI be liable for any damages, including, but not limited to, special, incidental, consequential or exemplary damages, that result from the use of our Products and Services, including this Web Site, even if BBSI has been advised of the possibility of such damages.

Amendment

BBSI reserves the right to review and revise this Privacy Policy from time to time without prior notice. For this reason, we encourage you to review this Privacy Policy periodically (at least annually). Your use of these services following any such modification constitutes your acknowledgement and acceptance of this Privacy Policy as modified. The last date this Privacy Policy was modified is set forth below.
